§1. Provider and contact
- The fdsrun.com service is operated by Fire Protection Solutions Jakub Baran, an entrepreneur entered in the Central Register and Information on Economic Activity (Centralna Ewidencja i Informacja o Działalności Gospodarczej, CEIDG), address: ul. Grzybowa 7A/2, 05-825 Grodzisk Mazowiecki, tax ID (NIP) 6182094888, statistical number (REGON) 528892780 (hereinafter: the Provider).
- Contact: e-mail biuro@fp-solutions.pl, telephone +48 790 782 993 (working days 9:00–17:00). This address is also the point of contact within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act); contact is possible in Polish and English.
§2. Definitions
- Service — the fdsrun.com web portal.
- User — a natural person, legal person or organisational unit that has created an Account.
- Consumer — a User who is a natural person concluding a contract not directly related to their business or professional activity. The provisions concerning Consumers also apply to a natural person running a business where the contract is not of a professional nature for that person (Article 7aa of the Consumer Rights Act (ustawa o prawach konsumenta)).
- Job — a one-off digital service: performing calculations with the FDS program (Fire Dynamics Simulator), in the version selected by the User, for an input file supplied by the User, on a server made available for the duration of the calculations.
- Model — the .fds input file and the data it contains; it remains the property of the User.
- Results — the files produced by FDS and Smokeview during a Job, together with the report and archives prepared by the Service.
- Balance — a prepayment made by the User (an Account top-up) against which Jobs are settled.
§3. Type and scope of services
- The Provider provides the following by electronic means: (a) maintaining an Account, (b) analysis of an .fds file with an estimate of the calculation time and price (free of charge), (c) Jobs (for a fee), (d) storing and making available the Results for 30 days (included in the price of the Job), (e) e-mail notifications (free of charge).
- The service consists solely of performing calculations. The Provider does not verify the physical or engineering correctness of the Model, the assumptions or the input data, does not interpret the Results and does not prepare expert opinions. The Results are neither the opinion of an expert appraiser nor a design document. The User is responsible for the Model, the choice of parameters, and the conclusions and documents prepared on the basis of the Results. The User expressly accepts this feature of the service with every order (Article 43k(5) of the Consumer Rights Act).
- FDS and Smokeview are software of the National Institute of Standards and Technology (USA), in the public domain, made available “as is”, without warranty. NIST does not endorse or certify the Service. The Provider runs the official NIST packages unmodified.
- Calculations are performed on servers in the European Union (Hetzner Online GmbH, Germany or Finland). The computing server is created for the duration of the Job and deleted, together with its data, after the Job ends.
§4. Technical requirements and rules of use
- To use the Service you need: a device with internet access, an up-to-date browser (Chrome, Edge, Firefox, Safari) with JavaScript enabled and support for the cookies necessary for the Service to work, and an active e-mail address. Model files: .fds format or a ZIP archive containing .fds files, up to 50 MB per file.
- It is prohibited to supply unlawful content, including files infringing the rights of third parties or malicious software, and to use the servers for purposes other than FDS calculations (e.g. cryptocurrency mining, network attacks, sending spam). The Provider may terminate such a Job and block the Account.
- The Provider does not provide services to persons and entities subject to European Union sanctions.
§5. Account — conclusion and termination of the contract
- The contract for maintaining an Account is concluded when the Account is created (with an e-mail address and password, or by signing in with Google or Microsoft) and these Terms are accepted. It is free of charge and concluded for an indefinite period.
- The User may delete the Account at any time (in the settings or by writing to biuro@fp-solutions.pl); the contract is then terminated. Any unused Balance is refunded in accordance with §8.
- The Provider may terminate the contract with 14 days' notice for important reasons (discontinuation of the Service, a change in the law) or with immediate effect where the User grossly breaches §4(2) or (3).
§6. Job — order and price
- After the Model is uploaded, the Service displays the analysis, server options with the forecast time and cost, the hourly rate and the method of calculating the price. The forecast is indicative; the Service states the typical range of deviation.
- The contract for performing a Job is concluded when the User ticks the required declarations and clicks the “Order with obligation to pay” („Zamawiam z obowiązkiem zapłaty”) button. The Service confirms the order by e-mail (a durable medium) with a description of the Job, the method of calculating the price and the declarations made.
- Method of calculating the price: price = actual running time of the computing server (from creation to deletion of the machine, to the second) × the hourly rate for the selected server type, Model size and Account type, shown next to the server option before the Order is placed and in the Order confirmation. There is no minimum or start-up fee. Prices for businesses are stated net; for Consumers, 23% VAT must be added.
- Currency. Accounts of Users from Poland are settled in Polish zloty (PLN), and Accounts of Users outside Poland in euro (EUR): rates, prices, the Balance, top-ups, invoices, payments and refunds are stated in that currency. The Account currency follows the country given in the invoicing details; after the first payment or invoice it no longer changes. Invoices in euro state the National Bank of Poland mid rate required by VAT law.
- If, during the calculations, the time forecast exceeds the estimate by more than 30%, the Service informs the User of this in the Job view and by e-mail. Calculations are not interrupted because of cost; the User may stop them at any time and pays for the time up to stopping, and the Results up to that point remain available. The User may set a project budget; once it is exceeded, new Jobs wait for confirmation.
- The first 2 minutes of calculations are a test run: if FDS stops with an error during it, the Job is free of charge. If the calculations end with an error later for reasons attributable to the Model, the User pays for the time used. If the cause lies with the Service (server failure, interruption by the Provider), the Job is free of charge.
§7. Payments
- Prepayment (Balance). The User tops up the Account with a chosen amount (from PLN 20 net, or from €5 net on an Account settled in euro) by card, BLIK or Przelewy24 (via Stripe) or by bank transfer. A VAT invoice is issued for the payment. A completed Job is deducted from the Balance at the price determined under §6(3); a Job can be started when the Balance covers its estimate. After a Job is completed the Balance may become negative (calculations are not interrupted because of cost) — the next Job then requires a top-up. The Balance does not expire.
- Payment after completion is available to a business with a verified tax ID (NIP) (Ministry of Finance register) or EU VAT number (VIES), and to any User who has saved and verified a payment card. An invoice is issued after each Job or collectively for the month (at the User's choice), with a 14-day payment term; where a card is saved, the invoice is charged to the card automatically once issued. For a new Account, the total of unpaid Jobs is limited to PLN 500 net until the first invoice is paid.
- Card verification is a PLN 0 authorisation hold with authentication at the bank; card details are stored exclusively by the payment operator Stripe, and the Provider knows only the card type and its last four digits. The card can be removed at any time under “Billing details”.
- Online payments are handled by Stripe Payments Europe, Limited (Ireland). The operator does not accept payments below PLN 2 (€0.50) — for online payment, an invoice for a smaller amount is topped up to that amount; payment by bank transfer is for the exact amount.
- When an invoice is overdue, the starting of new Jobs is suspended until it is paid; access to the Results remains. In professional (business-to-business) dealings, statutory interest for late payment in commercial transactions and compensation for debt recovery costs are due.
- Invoices are issued electronically, in the National e-Invoicing System (Krajowy System e-Faktur, KSeF) to the extent required by law, and made available in the Account and by e-mail. Services for businesses from other EU Member States are invoiced with the annotation “reverse charge” („odwrotne obciążenie”).
§8. Refunds
- We refund any unused Balance on a request (by e-mail to biuro@fp-solutions.pl) made within 24 months of the last top-up — within 14 days, using the same payment method (or, where that is not possible, by bank transfer to an account indicated by the User), without deductions. After that period the Balance does not expire and can still be used for Jobs.
- A Job interrupted for reasons attributable to the Service and a Job stopped with an error during the test run are not chargeable; if they have already been paid for or deducted from the Balance, the amount is returned to the Balance or — on request — to the payer's account within 14 days.
- Where a complaint is upheld, the refund is made within 14 days of it being upheld, using the same payment method.
- A correctly performed Job is not refundable on the grounds that the Results do not meet the User's expectations — the Results depend on the Model (§3(2)).
§9. Results and data
- The Model and the Results are confidential. The Provider does not use them for purposes other than performing the Job and does not disclose them to third parties, except to the subcontractors listed in the privacy policy and in cases required by law. On request, the Provider will conclude a non-disclosure agreement.
- The Results are stored for 30 days from the end of the Job, after which they are permanently deleted. The User may delete them earlier.
- The Service administrator has the technical ability to view the Model and the Results for diagnostic purposes; each such access is recorded in the Job history visible to the User.
- For Users who are businesses, with respect to personal data contained in Models, the data processing agreement, which forms part of these Terms, applies.
§10. Liability
- The Provider makes every effort to ensure that the Service operates without interruption, but does not guarantee continuous availability. Maintenance work is announced in the Service.
- Towards Users who are not Consumers, the Provider's liability is limited to the amount paid for the Job to which the damage relates and does not cover lost profits or damage resulting from decisions, designs and documents based on the Results.
- Towards Consumers, the Provider is liable in accordance with the Consumer Rights Act; the provisions of paragraph 2 do not apply.
§11. Consumers: withdrawal from the contract, conformity with the contract, complaints
- A Consumer may withdraw from the contract for maintaining an Account within 14 days of its conclusion without giving any reason, by sending a statement to biuro@fp-solutions.pl.
- With each Job, the Consumer requests that the calculations begin before the 14-day withdrawal period expires and acknowledges that once the service has been fully performed they lose the right of withdrawal (Article 38(1)(1) and (13) of the Consumer Rights Act). Without this declaration the Job cannot be started. If the Consumer withdraws from the contract during the calculations, they pay for the service performed up to the moment of withdrawal (Article 35).
- The Provider is liable to the Consumer for the conformity of the digital service with the contract (Chapter 5b of the Consumer Rights Act). The scope of the service is defined in §3(2).
- Complaints (including from Users who are not Consumers) may be submitted by e-mail to biuro@fp-solutions.pl or in writing to the Provider's address; it is advisable to state the Job identifier and a description of the problem. The Provider replies within 14 days on a durable medium; failure to reply within that period means that the Consumer's complaint is upheld.
- A Consumer may use out-of-court complaint and dispute resolution procedures, including applying to the provincial inspectorate of the Trade Inspection (wojewódzki inspektorat Inspekcji Handlowej) for mediation or resolution of the dispute, or obtaining free assistance from the district (municipal) consumer ombudsman (powiatowy (miejski) rzecznik konsumentów). Information and a list of bodies: polubowne.uokik.gov.pl. When replying to a complaint, the Provider states whether it agrees to such proceedings.
§12. Final provisions
- The contracts are governed by Polish law. For Consumers from other countries, this does not affect the provisions of their country's law that afford them greater protection. For Users who are not Consumers, the competent court is the court having jurisdiction over the Provider's registered office.
- These Terms are available free of charge in the Service, in a form that allows them to be downloaded, stored and printed, in Polish and English; in the event of any discrepancy, the Polish version prevails.
- The Provider may amend these Terms for important reasons (a change in the law, a change in the scope of services, security). The Provider gives notice of an amendment by e-mail at least 14 days in advance; a User who does not accept the amendments may delete the Account. Jobs started before the amendment are settled under the previous rules.
